A Willkie team led by partners Wesley Powell, Matt Basil and Jared Bartie was recognized by The AmLaw Litigation Daily with a “Shout Out” for a high profile win for collegiate athletic conference Mountain West Conference in a suit brought by members of San Jose State University’s women’s volleyball team and other Mountain West teams that played against SJSU. The suit sought to prohibit a transgender woman on the SJSU team from competing in MWC’s tournament and alter conference rules deeming any school’s refusal to play SJSU a forfeit.
On November 25, Judge S. Kato Crews of the United States District Court Judge for the District of Colorado in Denver, denied both the request to ban the player and to alter the rules, stating that the plaintiffs failed to demonstrate irreparable harm, notably by waiting until right before the Nov. 27-30 tournament to seek the injunction. On November 26, the 10th Circuit denied an emergency appeal sought by the plaintiffs, agreeing with Judge Crews.
