Willlkie’s litigators have been recognized by The AmLaw Litigation Daily for recently securing big wins on behalf of CareDX and CenturyLink in two separate securities class actions.
A Willkie team led by partners Charles Cording and Laura Leigh Geist received a “shout out” for scoring a significant victory for CareDx and its current and former officers in a securities fraud class action claiming that fraudulent Medicare billing practices alleged by a purported whistleblower rendered the company’s financial statements false. Judge Trina Thompson of the U.S. District Court for the Northern District of California granted Willkie’s motion to dismiss the complaint in its entirety, with leave to amend, as well as its motion to strike certain paragraphs that were directly sourced from the whistleblower’s lawsuit.
A separate Willkie team led by partners Sameer Advani, Tariq Mundiya and Philip DiSanto was also recognized with a “shout out” for securing the dismissal, for the second time, of a Colorado state securities class action filed against CenturyLink Inc. and certain of its officers and directors relating to CenturyLink’s $34 billion merger with Level 3 Communications, Inc. – one of the first ‘33 Act cases brought in Colorado after the U.S. Supreme Court’s 2017 decision in Cyan v. Beaver County Employees Retirement Fund. Adopting Willkie’s arguments, the court dismissed the amended complaint in its entirety, finding that the plaintiff failed to conduct a reasonable inquiry and instead relied on unproven allegations copied from a different class action lawsuit against CenturyLink.
