On October 19 at 10:40 local time in Hong Kong, partner Matthias Schrader will participate in the panel discussion titled, “Judicial Supervision: Vital Safeguard or Overreaching Risk?” as part of the GAR Live: Hong Kong conference.
Courts across the globe have different approaches to reviewing arbitral awards, with some proving heavier handed than others. The panel discussion will put various approaches and recent jurisprudence in several jurisdictions under the microscope and appraise where we lie with court supervision in major common and civil law jurisdictions. Panelists will discuss: comparative standards applied by courts when deciding whether or not to set aside/enforce awards, implications for the jurisdiction deriving from the courts’ approach to such questions, and whether a “transnational” or global approach to standards of review exists.
The GAR Live: Hong Kong conference will bring together eminent senior practitioners, including arbitrators, private practitioners, in-house counsel and more. Expect to discuss and debate the pressing issues affecting arbitration in Hong Kong and further afield, including court supervision of arbitration and the potential interplay between insolvency and arbitration.
