Willkie partner and Co-Chair of the Firm’s Financial Institutions/Regulatory Practice Group Rita Molesworth and senior counsel Paul Pantano will each chair a panel at the American Bar Association’s Derivatives and Futures Law Committee Virtual Winter Meeting 2022, taking place from January 26 – 28.
On January 27 at 10:45 am EST, Rita will chair the panel “CPOs, CTAs and Investment Advisers.” The panel will discuss issues including:
- CFTC developments (NALs, CPO-PQR and more)
- NFA developments (distress events, branch offices and more)
- Use of crypto (reporting obligations, custody for RIAs and ways to access)
- ETF developments
- AI and machine learning
- Archegos fallout (including family office regulation)
- 1940 Act Registered Funds (including use of derivatives and digital assets)
- Issues on the horizon
On January 27 at 1:15 pm EST, Paul will chair the panel “End Users.” This panel will discuss the regulatory aspects of a typical day in the life of commercial end-users and the dealers, exchanges and regulators who interact with them. The questions to be discussed include:
- Who is an end-user?
- How should end-users determine the regulatory treatment of new types of contracts, such as green energy contracts?
- What are the consequences for an end-user of characterizing a contract as a swap?
- How are rising commodity prices affecting end-users engaged in de minimis swap dealing?
- How end-users and their swap dealer counterparties comply with new federal and exchange position limits and exemptions?
- How are end-users managing the LIBOR transition?
Both Rita and Paul are past chairs of the Committee on Derivatives and Futures Law.
